Administrative Competence and the Authority to Act, which Causes Agreement to Be Null and Void

Abstract

Administrative competence may not be something new. However, the understanding of administrative competence in relation to the capacity to act objectively based on the principles of contractual formation has never been discussed. This study aims to discuss that in professional work, the contracts performing professional duty require administrative competency of the person who will perform the duty. In a particular contractual work, the person who consents to the contract shall have administrative competency of the work to be performed. The absence of administrative competency may cause the contract of work to become null and void.
